Terms & Conditions
The terms that apply to services provided by Libivert (Pty) Ltd. Last updated 17 October 2026.
1. Who we are
These terms apply to all services provided by Libivert (Pty) Ltd (Registration No. 2023/547362/07), 34 Eike Avenue, Roux Park, Worcester, South Africa (“Libivert”, “we”, “us”). Contact: services@libivert.com, WhatsApp +27 62 536 7296. By ordering from libivert.com you agree to these terms.
2. Our services
We provide web design and development, AI and automation solutions, web hosting, VPS and n8n hosting, content (video and streaming) hosting, and domain name registration. Services are described on the relevant page of this website and on your order or quotation.
3. Orders and acceptance
An order is accepted when we confirm it or when your payment is received. We may decline an order, for example where details are incomplete or the service is used unlawfully. Custom work is quoted first and the scope is confirmed in writing before work starts.
4. Prices and payment
Prices are shown in South African Rand (ZAR) and, where offered, in other currencies converted at the exchange rate applied by our system at checkout. Payment is made online through our payment providers (including PayPal and PayFast). We do not store your card details. Invoices are due on the date shown. Recurring services (such as hosting and support) renew automatically each billing period until cancelled, and we invoice before each renewal.
5. Delivery
Our services are digital. Delivery times and what to expect are set out in our Delivery & Refund Policy.
6. Refunds and cancellations
Refunds and cancellations are covered in our Delivery & Refund Policy, which forms part of these terms.
7. Web design projects
- Scope. The package, add-ons, number of pages and features are those on your order or written quotation. Anything outside that scope is a change request, quoted and charged separately before we do it.
- Payment. Packages are paid up front at checkout unless we agree a deposit and milestones in writing. Work starts once payment (or the agreed deposit) is received. The final website is launched once it is paid for in full.
- Your responsibilities. You supply the text, logos, images and other content we need, and give feedback within a reasonable time (we aim to respond within 2 business days). Delays on your side move the delivery date and may pause the project. If a project is inactive for 30 days we may close it; work done is then charged under the Delivery & Refund Policy.
- Content and copyright. You confirm that you own or may use everything you give us (text, images, trademarks) and that it is lawful. You are responsible for it, and you indemnify us against claims arising from it. Stock images, fonts or plugins we license for you may carry their own licence terms.
- Revisions. Each package includes reasonable revision rounds on the design while it is being built, as agreed in the quotation. Changes after you approve a stage, or requests that change the agreed scope, are charged at our hourly rate.
- Approval and launch. When you approve the website, or use it live, it is treated as accepted. Defects in what we built are fixed free of charge if you report them within 30 days of launch.
- Ownership. When the project is paid in full you own the final design and the content we created for you. We keep ownership of our own tools, code libraries, templates and know-how, and give you a non-exclusive licence to use them as part of your website. Until payment in full, all work remains ours.
- Portfolio. We may show the finished website in our portfolio and marketing unless you ask us in writing not to.
- Third-party tools. Websites may rely on third-party software (for example WordPress, plugins, payment providers, Tutor LMS). We are not responsible for changes, outages, fees or licence terms set by those providers.
- No guarantees of results. We build to professional standards but cannot promise search rankings, traffic, sales or enquiries.
- After launch. Updates, maintenance and support after the 30-day defect period are not included unless you buy a support package or pay our hourly rate.
8. Hosting and acceptable use
These terms cover web hosting, content (video and streaming) hosting, VPS and n8n hosting.
- Term and renewal. Hosting is billed monthly or annually in advance. It renews automatically for the same period until you cancel, and we send an invoice before each renewal. To avoid being charged for the next period, cancel before the renewal date.
- Acceptable use. You may not use hosting for anything unlawful, or for spam, malware, phishing, hacking attempts, hosting of illegal or infringing content, adult content where prohibited by law, open mail relays, or anything that harms other customers or our network. You are responsible for all content on your account and for keeping your passwords secure.
- Fair use and resources. Plans have the storage, bandwidth and resource limits stated on the plan. If your usage affects other customers or the stability of the server, we may ask you to reduce it, move you to a suitable plan, or throttle or suspend the service. Content hosting and video streaming are subject to the bandwidth and storage of your plan.
- Availability. We work hard to keep services running but do not guarantee uninterrupted or error-free service. We may schedule maintenance and will try to give notice. Outages caused by third parties, network providers, force majeure or your own actions are not our responsibility.
- Backups and data. You are responsible for keeping your own backups of your website and data. Where we run backups, they are a courtesy and not a guarantee that data can be restored.
- Security and updates. You are responsible for keeping your website software, plugins and themes updated. We are not liable for hacking or malware caused by outdated or insecure software or weak passwords.
- Self-managed services. For VPS and n8n hosting you are responsible for the software, configuration, security and data you run on it, unless you buy a management or support package.
- Suspension and termination. We may suspend or terminate a service, after notice where practical, if it breaks these terms, is used unlawfully or remains unpaid after reminders. Accounts overdue for 30 days or more may be deleted, and the data on them cannot be recovered.
- Cancellation and refunds. You may cancel at any time. Refunds are handled under our Delivery & Refund Policy.
- Price changes. We may change hosting prices with at least 30 days’ written notice before your next renewal.
9. Domain names
Domains are registered through our registrar partner and are subject to the rules of the relevant registry. You must give accurate registration details. Registration and renewal fees are non-refundable once a domain has been registered, unless the registry or law requires otherwise. Domains not renewed before expiry may be lost or become subject to redemption fees.
10. Intellectual property
Our website, brand, software and materials remain ours. You keep ownership of the content you give us, and you confirm you have the right to use it.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or data, or for events beyond our reasonable control. Our total liability for any claim is limited to the amount you paid us for the service concerned in the three months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.
12. Privacy
How we handle your personal information is described in our Privacy Policy.
13. Changes and governing law
We may update these terms; the version on this page applies to new orders. These terms are governed by the laws of the Republic of South Africa.
